Abosolutely no chance in hell of Sai being dead at this time. Like it has been mentioned before, he will eventually be another character changed by Naruto. Mark my (and many other's) words.

Probably just hung him there. Doesn't mean his necessarily dead... yet.
Or could be just one of his ink clones to make the wood clone lose the real (not clone) track.
