Maybe it was still material in the last war, and Shirou's dad got it to stay somehow after Saber herself was gone.
It could also just be that he got it through more mundane means (found it? Inherited it from his teacher? Summoned it from some other place?)
Saber's pretty matter-of-fact about him possessing the scabbard, and it seems to me like her being summoned at all was contingent on the scabbard as a bond to contract with her (but that may just have been the condition for Shiro, because of his lack of training). Still, if he had it before he had her, it would make sense for him to be able to use it to summon her, and would also make sense for him to have it afterwards.
We don't really know a whole lot of anything about the elder Emiya, but we know he was a particularly competent magician, who was also apparently pretty handy with a gun, and had a certain degree of morality beyond the expectations of the average magician... who knows? Maybe he's Merlin's heir?

amazing episode, so much information and emotions in it, very awsome. Well i was right sorta about gilgamesh's master. But what an evil bastard, all he wants is destruction.
Also i believe he was gilgamesh's master in the last war. Saber was not able to defeat gilgamesh but shirou's father did defeat his master, but shooting him. He survivored becuase the one who makes the wish is protected by the holy grail.
The only pact that was made was with lancer, gilgamesh was already his servant.

Finally had time to watch this episode and man did I like it. Seems that I was right in thinking that Kotomine was Gil's master and Board was right about Lancer's origional master being female. The thing I find weird is that Lancer seemed pretty noble, it just seems weird that he would both let his Master be killed and then make a pact with the person that killed her. I was also hoping Gil would use the scyth again, I need to stop watching the opening since it spoils scenes from the current ep but it's so catchy.
